TERMS AND CONDITIONS

NANO HYGIENE LTD

These terms and conditions apply to all our sale of Goods Contracts and govern your use of our website https://www.nanohygiene.co.nz (together or individually “Service”) operated by Nano Hygiene Ltd.

Any orders placed with Nano Hygiene by the Customer constitutes your agreement to be bound by these terms.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

1. DEFINITIONS

In these terms and conditions, unless the context otherwise requires:

1.1 “Nano Hygiene,” “Our,” “Us,” “We,” shall mean Nano Hygiene (NZ) Ltd

1.2 “Customer,” “You,” means the Person or Organisation named in the relevant Sales Invoice or Quotation.

1.3 “Consumer Guarantees Act” means the Consumer Guarantees Act 1993 (NZ). and the Fair Trading Act 1986, and any other relevant legislation relating to consumers.

1.4 These Terms of Service (“Terms”, “Terms of Service”)

2. PURCHASE AGREEMENTS

2.1 If You wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.

2.2 You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

2.3 We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

2.4 We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or error in your order or other reasons.

2.5 We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

3. PRICING POLICIES AND TAXES

3.1 Prices quoted are including GST unless otherwise stated.

3.2 Nano Hygiene reserves the right to change the prices of Goods at any time without notice to you. The price displayed at the time that you place your Order will continue to apply to you even if the price changes before your Order is accepted by Nano Hygiene.

3.3 In addition to the price for the Goods, you will also need to pay a delivery fee (“Shipping and Handling”), will appear in your shopping cart. By placing an Order you agree to pay the price for the Goods (including GST), and Delivery Charge.

4. DELIVERY

4.1 Goods will only be delivered to New Zealand addresses or to New Zealand PO Boxes where possible depending on the size of the Goods.

4.2 Following dispatch of your Goods, Nano Hygiene will email the Customer with dispatch confirmation, including a tracking number and an invoice for your Order.

4.3 On delivery the Customer may be required to sign a proof of delivery. If you are not available, your Goods will be taken to a local depot or post office and a calling card containing the relevant contact details will be left at the delivery address.

5. DELAY IN DELIVERY OF GOODS & AVAILABILITY

5.1 You agree and acknowledge that Nano Hygiene does not guarantee the delivery or availability of Goods within given timeframe, events outside Nano Hygiene's control may cause delays, or in some circumstances, prevent your Goods from being delivered, delays are particularly likely to occur during public holidays, Christmas and New Year.

6. REFUND

6.1 Nano Hygiene will process refund within 3-5 business days once Goods are received in As New and Unmarked Condition, including Packaging material and instructions. The additional time that it takes for the Customer receive refund will depend upon how quickly the Customer’s financial institution processes the refund.

6.2 Delivery charges will not be refunded and in some instances the Customer may be charged for collection.

6.3 The Customer is not entitled to any refund or exchange just because any packaging is damaged in transit. The packaging exists to protect the Goods themselves.

7. DEFECTIVE GOODS

7.1 The Customer shall inspect the Goods on delivery and shall within two (2) days of delivery notify info@nanohygiene.co.nz of any alleged defect, shortage in quantity or damage.

7.2 If the Customer fails to comply with these provisions, the Goods shall be conclusively presumed to be in accordance with the terms and conditions and free from any damage or defect.

8. CONSUMER GUARANTEES ACT 1993

8.1 If You are purchasing goods or services from Nano Hygiene online for business purposes, as defined in sections 2 and 43 of the Consumer Guarantees Act, You agree that the consumer guarantees provided for in the CGA will not apply to the supply of those goods or services.

9. PRIVACY ACT 2020

9.1 Nano Hygiene collects and holds personal information in accordance with its obligations under the Privacy Act 2020. By using Our Service, Your personal information is collected to provide You with the benefits of receiving special offers, subscribing to newsletters, marketing or promotional materials and other information we may send. However, You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing info@nanohygiene.co.nz.

9.2 We may use third-party Service Providers to monitor and analyze the use of Our Service.
